Welcome to Hot Yoga Waikiki and HYPE (Hot Yoga Pilates Evolution), operated by Dream It Plan It Do It Corporation (“Company,” “we,” “our,” or “us”). These Terms of Use govern your access to and use of our websites, mobile applications, online services, and in-studio systems (collectively, the “Services”), including any reservations, memberships, classes, products, or features provided by Hot Yoga Waikiki, HYPE, or our future facilities.

By using our Services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use our Services.

1. Eligibility

You must be at least 18 years old or have the consent of a parent or legal guardian to use our Services. You represent that any information you provide is true, accurate, and complete.

2. Studio Etiquette and Safety

To ensure a safe and respectful environment:

• You must follow all class guidelines, posted signage, and instructor directions.

• You agree not to practice alternative methods during structured classes (e.g., Original 26&2).

• If you have medical conditions, injuries, or concerns, consult your physician and notify staff before participating.

• You assume full responsibility for your physical condition and participation in all classes or services.

Right to Refuse Service:
We reserve the right to refuse service or access to our facilities, classes, or services to any individual at our sole discretion. This includes, but is not limited to, individuals who are disruptive, disrespectful, appear intoxicated, fail to follow studio rules, or pose a risk to themselves, others, or the studio environment. No refunds will be issued in such cases.

Hot Yoga Waikiki and HYPE reserve the right to permanently ban individuals who violate these standards or disrupt the safety and harmony of our studios.

3. Reservations, Payments & Cancellations

All reservations, purchases, and memberships must be made online or via text. We do not process bookings through email.

Cancellations or Freezes:

• A minimum of 7 days’ notice is required for freezing or cancelling memberships.

• A doctor’s note may be required for cancellation due to health reasons.

• Class cards do not expire unless otherwise stated.

• Missed or late-cancelled classes may result in charges in accordance with your package terms.

All monetary transactions are paperless; receipts are emailed.

4. Cold Plunge & Red Light Therapy

By booking or using these services:

• You acknowledge that exposure to hot or cold temperatures, or light-based technologies, carries health risks.

• You agree to use these services at your own risk and release the Company from liability for any adverse effects.

You may be required to sign a separate waiver in-studio.

5. Intellectual Property

All content on our websites, class names, logos, materials, videos, and written descriptions are the property of Hot Yoga Waikiki, HYPE, or licensed third parties. You may not reproduce, republish, or distribute our materials without written permission.

6. Prohibited Conduct

You agree not to:

• Misuse our booking system or impersonate another person

• Attempt to access non-public areas of our systems or facilities

• Record classes or share copyrighted material without consent

• Harass or disrespect staff, teachers, or other members

Violation of these rules may result in account suspension or permanent removal from our studios and online services.

7. Disclaimers

Our classes and wellness services are not medical treatments and should not be used as a substitute for professional healthcare. Always consult your physician before beginning any new fitness program or therapy.

We make no guarantees regarding specific results or outcomes from our Services.

8. Limitation of Liability

To the fullest extent permitted by law, Hot Yoga Waikiki, HYPE, and affiliated parties shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of our Services—including but not limited to physical injury, lost profits, data breaches, or service interruptions.

9. Indemnification

You agree to indemnify and hold harmless Hot Yoga Waikiki, HYPE, and our affiliates, employees, and partners from any claims, damages, or expenses arising from your use of the Services, your conduct, or your violation of these Terms.

10. Changes to Terms

We may update these Terms from time to time. Revised terms become effective when posted. Continued use of the Services after changes constitutes your acceptance of those updates.

11. Governing Law

These Terms are governed by the laws of the State of Hawaii, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Honolulu, Hawaii.
