Student Agreement, Terms & Conditions, and Waiver

PART ONE — BEFORE YOU BEGIN

The following section is provided for informational purposes to help you get started with H•Y•P•E Studios. Please review this information prior to your first visit. The legal waiver and agreement begin in Part Two.

PAYMENT & MEMBERSHIP OPTIONS

 

All memberships and class packages must be purchased prior to attending class. Payment is accepted online through your student account or in-studio. We accept all major credit cards.

 

Membership options include unlimited monthly memberships and class packages of varying sizes. Current pricing is available at www.hotyogawaikiki.com and www.HYPECities.com. Memberships are nontransferable and non-refundable for partial months used.

RESERVATIONS

 

Reservations are required for all in-studio Activities and must be made in advance through your student account. Walk-ins are subject to availability and not guaranteed.

Please arrive at least 10 minutes before class. Late arrivals may be turned away to respect the experience of other students.

CANCELLATION & FREEZE POLICIES

 

We understand life happens. Please cancel your reservation as early as possible to allow other students to take your spot.

 

• Early cancellations (before the cancellation window) will not be penalized.

• Late cancellations or no-shows may result in a class credit deduction or late cancel fee, depending on your membership type.

• Membership freezes are available for qualifying circumstances. Freeze requests must be submitted in advance and are subject to billing cycle terms.

• Full cancellation of a membership must be submitted before the next billing cycle to avoid additional charges.

STUDIO RULES & WHAT TO EXPECT

 

Our studios are heated environments. Please come prepared:

 

• Bring a mat, towel, and water bottle. Rentals may be available at select locations.

• Wear appropriate fitness attire suited for hot conditions.

• Silence all electronic devices before entering the studio.

• Respect your fellow students and instructors. Our space is for everyone.

• Hot Pilates, Hot Yoga, and HIIT classes take place in a heated room. Inform the front desk of any health conditions before your first class.

• Cold plunge and red light therapy sessions are available at select locations and require a separate reservation or add-on.

 

The Studios reserve the right to refuse service or remove any student for disruptive, unsafe, or inappropriate behavior without refund.

PART TWO — LEGAL AGREEMENT & WAIVER

This Agreement (the "Agreement") is between the undersigned student ("Student") and Dream It Plan It Do It Corporation, dba H•Y•P•E | Ewa Beach • Kapolei & H•Y•P•E | Hot Yoga Waikiki (collectively referred to as "Studios" or "HYPE"), with a primary studio address at 449 Kapahulu Ave. Ste. 208, Honolulu, HI 96815, and any additional or future locations operated by the Studios.

 

By signing below, creating an account, registering online, or participating in any activity at or through the Studios, Student agrees to the following Terms and Conditions:

 

 

I. STUDIO PARTICIPATION

 

Participation in Studios' classes and activities (collectively, "Activities") requires an active account with a valid payment method on file. Reservations are required for all Activities and must be made prior to attendance. Students agree to follow all rules and staff instructions during participation.

 

Note: H•Y•P•E Studios uses Zoom technology for internal recording purposes only. Remote livestream access for participants is not currently available. This feature may be offered in the future, at which time updated terms will apply.

 

 

II. HEALTH & ILLNESS ACKNOWLEDGMENT

 

I understand that participation in group fitness activities carries a risk of exposure to contagious illnesses, including but not limited to COVID-19, RSV, and influenza. I agree not to attend in-person classes or use studio facilities if I am feeling unwell or exhibiting symptoms of a potentially contagious illness. I accept full responsibility for any risks related to exposure to communicable diseases in connection with the Studios.

 

 

III. RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

 

I understand that my participation in Activities involves physical exertion, exposure to heated environments, cold water, red light, and potential risks of injury, illness, or death. This includes but is not limited to:

 

• Yoga and hot pilates fitness classes

• Cold Plunge Therapy (exposure to extreme cold temperatures)

• Red Light Therapy (exposure to red or near-infrared light)

 

I certify that I am physically and mentally fit to participate in these Activities. If unsure, I have consulted a medical professional.

 

Cold Plunge Specific Risks

• Sudden changes in heart rate and blood pressure

• Potential dizziness, shock, or hypothermia

• Risk of falling or slipping in wet areas

 

Red Light Therapy Specific Risks

• Skin sensitivity or irritation

• Photosensitivity due to medications or conditions

• Not advised for those with implanted medical devices without consultation

 

I acknowledge these services are not medical treatments and waive all claims arising from participation.

 

I voluntarily release, waive, and discharge the Studios, their affiliates, staff, instructors, contractors, and agents from any liability related to participation in any Activities, including those caused by negligence or conditions of the premises. This release is binding on my heirs, executors, and assigns.

 

I grant permission for the Studios to use my image, voice, or likeness in any promotional materials without compensation.

 

 

IV. MEMBERSHIPS AND CLASS PACKAGES

 

Memberships and class packages are nontransferable and subject to terms published at www.hotyogawaikiki.com and www.HYPECities.com. Freeze and cancellation policies apply based on billing cycles. Refunds are not provided for partial months.

 

 

V. GOVERNING LAW & ARBITRATION

 

This Agreement is governed by the laws of the State of Hawaii. Any disputes will be resolved by binding arbitration under the rules of the American Arbitration Association.

 

 

VI. SMS/TEXT MESSAGING CONSENT

 

By registering with H•Y•P•E Studios, creating an account, or providing your phone number through any registration form, website, or in-studio sign-up, you expressly consent to receive automated and non-automated text messages from Hot Yoga Waikiki and HYPE Studios. These messages may include:

 

• Class booking confirmations and reminders

• Schedule changes or class cancellations

• Account updates and billing notifications

• Promotional offers, events, and studio announcements

• Other service-related notifications

 

Message and data rates may apply. Message frequency varies. You may opt out at any time by replying "STOP" to any message. For help, reply "HELP" or text us directly at (808) 468-9642 — you will reach a real person, not an automated system.

 

Consent to receive text messages is not a condition of purchase or participation in any Studios' Activities.

 

Your contact information will never be sold or shared with third parties. It is used solely for communications related to your membership and studio activities.

 

 

VII. ADDITIONAL TERMS FOR SAFETY AND RESPONSIBILITY

 

Emergency Medical Consent

In the event of a medical emergency, I authorize Hot Yoga Waikiki, HYPE, and their staff to obtain emergency medical treatment for me (or my child), and I agree to be financially responsible for any associated costs.

 

No Guarantees Clause

I understand that individual results from fitness or wellness programs may vary, and no specific outcome is guaranteed by the Studios or their staff.

 

Behavior Policy

I acknowledge that the Studios reserve the right to refuse service or revoke participation without refund in cases of disruptive, unsafe, or inappropriate behavior.

 

Minors Policy

If a minor participates in any Activities, they must be accompanied by a parent or legal guardian unless otherwise approved in writing. The parent or guardian assumes all responsibility and liability on behalf of the minor.

 

 

VIII. STUDENT ACKNOWLEDGMENT

 

I acknowledge I have read this Agreement in full, understand its contents, and agree to be bound by its terms. I understand that by signing this waiver, I am giving up certain legal rights.

 

If under 18 years of age, a parent or legal guardian must sign on behalf of the Student.
